The command theory\, in short\ , argues that law is best understood as a series of commands that legal su bjects habitually obey. One of Hart’s rejoinders to the command theory was that power-conferring rules cannot fit this definition without grotesque contortion. Legal powers are facilities which enable power-holders to brin g about legal changes\, such as the power to make a contract. Power-confer ring rules therefore are not commands to be obeyed by the power-holder\, b ut are instructions\, which if followed\, bring about consequences that ar e valid in law.\n\nIn this session of the DCL Research Series\, ºÚÁÏÍø Law DCL candidate Jo Murray will discuss the nature of power-conferring rules in the context of unwritten constitutionalism\, administrative law\, and fiduciary law.\n\nIn particular\, she will argue that legal powers generat e valid legal consequences through interactivity. Therefore\, we might bet ter define legal powers as interpersonal-actions-in-law. This formulation is suggestive of a constitutive connection between the rule of law and leg al powers\, and lays the groundwork for a theory of judicial review that e xplains how administrative agencies' powers are also established and gener ated through\, as opposed to only limited and constrained by\, the rule of law.\n\nºÚÁÏÍø Law DCL candidate Upasana Dasgupta will be the main discus sant.\n\nThe DCL Research Series takes place several times during the acad emic year. It's a platform for DCL candidates and other scholars to share their research and receive feedback.\n\nAll are welcome to attend! For mor e info\, contact the series’ convener\, Ivan Ozai (ivan.ozai [at] mail.mcg ill.ca).\n DTSTART:20200305T200000Z DTEND:20200305T210000Z LOCATION:NCDH 316\, Chancellor Day Hall\, CA\, QC\, Montreal\, H3A 1W9\, 36 44 rue Peel SUMMARY:DCL Research Series: The Constitution of Power URL:/law/channels/event/dcl-research-series-constituti on-power-320839 END:VEVENT END:VCALENDAR
